CREATIVE SOW/DEAL STRUCTURING

The successful pathway into any environmental project generally starts with a strategically crafted scope of work, which is subsequently crafted into individual work plans.

PNL’s philosophy is that the formulation of these documents is one of the most important project tasks. We have worked with many sophisticated clients to craft project planning documents, which have flexibility, yet possess a long shelf life and “steer” the project in the clients’ interests.

We have prepared SOWs, which become embodied in Consent Decrees or Orders.

We make extensive use of decision trees that anticipate future milestone decision points, and in general, attempt to reduce what will be classified as impacted materials.

Case Studies:

• PNL recently assisted the Ascon Site PRPs formulate an SOW for the management of up to one million cubic yards of oil-impacted sludges and soils.
• PNL personnel wrote an SOW for the PAB Superfund Site, which contained a multi-remedy option decision tree. This figure helped the PRPs later minimize the site waste volumes that needed to be stabilized to more stringent EPA standards.
• We have formulated SOWs where certain work is only triggered based on findings from the early work.
• We have been strong advocates for planning contingency remedies where work would only proceed based on certain prescribed data findings.
