COST RECOVERY AGAINST THE U.S.

Many of the facilities that border the Passaic River could be sources for river sediments impacts.

However, from a liability perspective, some of these facilities may have been operated under the oversight of the United States, for example, during war efforts.

PNL has the experience and expertise to work with archival search and legal teams who potentially may pursue such a defense strategy. We have an extensive array of network partners in Washington, D.C. who can direct searches within the Federal Archives.

In particular, team member Steve Werner, has recently assisted a major client pursue war claims against the US.

Case Studies:

  • Steve Werner recently worked for a law firm on behalf of a major petrochemical organization. Steve assisted in the development of a technical strategy and managed the technical resources to pursue a claim against the United States for environmental damages associated with the production of war material.
  • Ian Webster has assisted major oil companies in their act of war defense to recover remediation response costs at the McColl Superfund Site in Fullerton, CA. He examined historical waste flow pathways and linked site areas and thereby response costs to the U.S.
  • Project Navigator has recently assisted the PRPs at the Tex Tin Superfund Site design and construct the remedy. More than half of the remedy costs were borne by the US due to facility operations during wartime.
